1. New EEOC Rules and Guidance – Pregnancy Worker Fairness Act
On June 18, 2024, the EEOC’s final rules and interpretive guidance on the Pregnant Worker Fairness Act (PWFA) went into effect, reflecting a broad interpretation of the law. This session will cover:

  • Whether partners, spouses, or family members have legal rights under the PWFA
  • Whether PWFA applies to post-pregnancy parental bonding or childcare requests
  • What conditions actually fall under the PWFA? (Hint – EEOC rules reach far beyond pregnancy – e.g., infertility, menstruation, abortion)
  • Whether an employer must temporarily eliminate essential job functions
  • What supporting medical documentation can be required, if any
  • What “undue hardship” is under the PWFA as opposed to the ADA

2. Status of the FTC’s Proposed September 2024 Ban on Non-Competes – Including TRAP Agreements

  • Understanding the implications of the proposed ban on non-competes, including TRAP (Training Reimbursement Agreements, which may be considered reverse non-competes)
  • Exploring alternative solutions to TRAP Agreements

3. Overview of Major U.S. Ninth Circuit 2024 Court Decisions Impacting Employers (ID,WA, OR, NV, AZ, MT, AK, HI)

  • Whether military, jury duty, and bereavement leaves must now be paid
  • Employers’ harassment liability for workers’ off-duty social media posts
