Membership Services

Management Northwest is a membership-based organization that provides employers with preventative employment law services as part of a flat annual membership fee. The membership year starts the date of the on-line registration and runs for one year from the date of on-line registration.

Annual Membership Fee based on number of employees (including owners, PT, temporary, and FT workers).

Commencing January 1, 2022, membership pricing is as follows:

  • Tier 1 – 1-15: $2750
  • Tier 2 – 16-39: $3100
  • Tier 3 – 40-100: $3600
  • Tier 4 – 101-200: $3700
  • Tier 5 – 201-300: $3900
  • Tier 6 – 301-500: $4200
  • Over 500 – Contact MNW for pricing

The following Services are included in the Annual Membership Fee Price:

    The drug test positivity rate among America’s workforce reached its highest rate in 2021 since 2001. (Source: Quest Diagnostics, the world’s leading provider of diagnostic information services). As employers strive to create and maintain safe workplaces, the 2021 positivity rate represented an increase of 31.4 percent from the all-time low of 3.5% just 10 years ago. Spikes in positivity rates even from 2020 to 2021 were staggering for cocaine, methamphetamines, and marijuana.

    This session is presented by two employment lawyers who previously served as a criminal prosecutor and public defender handling drug and alcohol related offenses. The presenters will provide an overview of workplace drug and alcohol issues, as well as discuss employer obligations and risks as analyzed by OSHA and applicable laws. Presenters will review drug and alcohol policies and make suggestions based on industry, paying particular attention to addressing how employers should navigate the legalization of marijuana in some states. This session will also tackle reasonable suspicion testing, including providing detailed guidance on identifying symptoms consistent with alcohol and drug impairment. It will address post-accident testing legal restrictions, pre-employment testing pros and cons, searching employees for drugs, and whether zero tolerance policies are still viable in the current workforce climate.

  • The Bullies Among Us: Maintaining Civility in the Workplace

    With the return of workers to the office, there has been a stark increase in workplace bullying. With low unemployment rates and workplace morale already low, employers can neither afford nor do they want to have a bully making the work environment toxic and driving away good workers. Unfortunately, bullying often occurs outside a supervisor’s presence or in off-duty communications, namely social media. In many instances the bully is an otherwise high performer.

    This session will address how to identify, document, fact find, and address protected class neutral bullying. Disciplining a bad attitude is difficult. Specific examples will be provided on how to do so in a manner that protects your organization from a legal challenge for wrongful termination. The presenters will also provide strategies to prevent workplace bullying and reduce the risks of a toxic work environment.

    This training is critical for any supervisors, managers, administrators, HR or executives who handle employees’ medical issues. It will include comprehensive instruction on a wide range of ADA compliance issues including case decisions and regulations relating to handling of mental and physical disabilities in the workplace. Form letters will also be provided for use in the required interactive process. The session will cover legal hotspots such as perceiving someone as disabled, addressing disabilities when not raised by the employee, whether discipline must be paused or reversed when a disability is raised as a reason for subpar performance, illegal and legal employer inquiries, and leaves of absence (FMLA and non-FMLA) as accommodations. The session will also provide guidance relating to developments in applying the ADA to mental conditions. Also included are accommodation analyses for vacant positions, transfers, removal of essential functions, leaves of absence, reduced productivity and flexible schedules, including what an employer is and is not responsible to provide.

  • Recording: OSHA Private Employer Vaccine/Testing Mandate

    OSHA just released its mandatory Emergency Temporary Standard (ETS) applicable to private employers with 100 or more employees. OSHA notes that it is contemplating extending this ETS to smaller employers as well, but has not yet done so. The ETS requires impacted employers to determine each employee's vaccination status, obtain acceptable proof of vaccination, maintain records and rosters relating to vaccination status, provide paid leave for obtaining vaccinations, require weekly testing (can be at employee's expense) and face coverings for unvaccinated workers, provide notifications of COVID-19 positive tests to employees and follow isolation protocols, provide employees with clearly written policies explaining the requirements of this ETS including, but not limited to, anti-retaliation/anti-discrimination language and information about the applicable laws that may result in criminal penalties for providing false information or documentation. The ETS also includes strict reporting requirements relating to work-related COVID-19 in-patient hospitalizations and deaths. Records must also be made available to employees as dictated by the ETS. This seminar will cover all of these topics and more on this mandate.
