Once the ADA (Americans with Disabilities Act) process is triggered, HR is legally required to engage in the interactive process. This session will address when ADA is legally triggered, how to handle the process of considering the reasonableness of accommodations, and what is needed to establish an undue hardship decision. Issues that will be addressed include the following accommodation requests:

  • Unpaid leave
  • Intermittent unscheduled time off
  • Indefinite leave of absence
  • Remote work
  • Modified work schedule
  • Modified duty (e.g., reduced lifting, bending, pushing, pulling, standing)
  • Removal of essential duties
  • Making exceptions to your company policies (e.g., attendance, breaks, uniforms)
  • Reassignment to another position

Undue hardship discussion will also include focus on:
* Inconvenience versus provable undue hardship – burden is on the employer
